How to remove a name from the deeds
What happens when someone comes off the title after a separation or change in circumstances.
Everyone must agree
A name can only be removed with the agreement and signature of the person coming off the title, unless there is a court order. If there is a dispute, speak to a solicitor.
The paperwork
A transfer deed (TR1) is signed by all current owners and witnessed, then submitted to HM Land Registry with form AP1 and identity evidence.
Mortgages and money
If there is a mortgage, the lender must agree to release the person leaving. If money is paid for their share, stamp duty may apply. Take advice where either applies.
Common questions
Can a name be removed without the other person agreeing?
No. The person coming off the title has to sign the transfer deed, unless a court order says otherwise. If anyone on the title disagrees, the case needs a solicitor rather than a paperwork service.
Does removing a name end their mortgage responsibility?
Not automatically. The register records who owns the property; the loan is separate, and the lender must agree to release the person leaving. Changing the register and changing the mortgage are two different things.
Is stamp duty payable when a name comes off the deeds?
It can be, if money is paid for the share or the remaining owner takes over mortgage debt. Where either applies, take tax advice before submitting the application.
This guide is general information about England and Wales, not legal or tax advice. We prepare and submit paperwork; mortgaged or complex cases are referred to a regulated solicitor.
